    Elin, thanks very much for your good answer as always. I had some time to have a look at the regulations on petition procedures and, to my understanding, it provides that (a bit different than what was said above):
    (1) Both US citizen and lawful permanent resident will be required to petition form I-130.
    (2) The spouse of such person will be required to petition I-485 in either case.
    (3) The difference between a US citizen case and the LPR case is that the visa for such spouse will be immediately available for the spouse of the US citizen to apply for a green card, once the petition by the US citizen (I-130) is approved. In the case of the spouse of the LPR, the visa will only be available when so advised by the State Department.
    In brief, the spouse of the LPR will need to apply for I-485 (instead of I-130) assuming she is residing in the US. Elin, you may wish to have a re-look at the issue in order to ensure this is correct information.

    Cám ơn ElinHoang và analyst. Như vậy Helen nên nộp đơn bảo lãnh trước khi anh ấy có quốc tịch để không bị out of status và phải nộp both I-130 and I-145. Bạn trai của Helen tháng 11 này sẽ chính thức ở US được 4 năm. Vậy hai bạn có thể ước lượng giùm Helen thời gian ngắn nhất mà Helen có thể được cấp thẻ xanh nếu Helen bắt đầu nộp giấy tờ từ lúc này!!!

    Chapter 10: Getting a Green Card Through Investment
     
    Privileges


    You may live anywhere in the U.S. and stay as long as you want

    When you first receive your green card through investment, you may work in your own company.  After a certain length of time, you may work anywhere you wish or not work at all

    You may travel in or out of the U.S. whenever you wish

    You may apply to become an American citizen after you have held your green card for at least 5 years

    If you qualify for a green card through investment, your spouse and unmarried children under the age of 21 may get green card as accompanying relatives
     
    Limitations


    You must maintain a large business investment in the U.S. for at least three year

    Your place of actual residence must be in the U.S. You cannot use a green card only for work and travel purposes.  (The only exception to this rule is for Alien Commuters, Chapter 4)

    You must pay U.S. taxes on your worldwide income because you are regarded as a U.S. resident

    You cannot remain outside the US for more than one year at a time without special permission, or you risk losing your green card

    If you commit a crime or participate in politically subversive activities or commit other proscribed activities, your green card can be taken away and you can be removed from the US (deported)

    A.  How to qualify
    Qualifying for a green card through investment (Employment Fifth Preference) has some limitations
     


    Quota Restrictions


    Green cards for investors are limited to 10,000 per year, with 3,000 of those reserved for persons investing in rural areas or areas of high unemployment.  Only principal applicants are counted in the quota.  Accompanying relatives are not.  Therefore, in reality, many more than 10,000 per year can be admitted with green cards through investment

    At present, green cards are available to all qualified applicants.  It appears unlikely that waiting periods will develop in the near future.  Petition approval normally takes from 2 to 6 months.  After petition approval, application approval should take an ad***ional 1 to 6 months.

    Who Qualifies for a Green Card Through Investment


    Green cards through investment are available to anyone who invests a minimum of $1 million in creating a new US business or expanding one that already exists.  The business must employ at least 10 full-time American workers.  The investor, his or her spouse and their children may not be counted among the 10 employees, but the investor must be active in the management of the company

    The required dollar amount of the investment may be reduced to $500,000 if the business is located in a rural area or in an urban area with an unemployment rate certified by the state government to be at least 150% of the national average.  Rural areas are defined as any location not part of an official metropolitan statistical area or not within the outer boundaries of any city having population of 20,000 or more.  State governments will identify the parts of the particular state that are high in unemployment, and will notify the INS of which locations qualify.  Even if you know that the area of your intended investment has extremely high unemployment, it will not qualify for the lesser dollar amount unless the state government has specifically designated it as a high unemployment area for green card through investment purposes.  Several state, including Texas, California, New York, Florida and Washington, have made such designations.

    The INS also has the authority to require a greater amount of investment than $1 million.  This may occur when the investor chooses to locate the business in an area of low unemployment.  At present, the INS has adopted the policy of not raising dollar investment requirements on this basis

    The entire investment does not have to be made in cash.  Cash equivalents such as certificates of deposits (COD), loans and notes can count in the total.  So can the value of equipment or inventory.  Borrowed finds may be used as long as the investor is personally liable in the event of a default, and the loan is adequately secured, and not by assets of the business being purchased.  This means that mortgages on the business assets disqualify the amount borrowed from being calculated into the total investment figure

    A number of investors may join together in creating or expanding a US business and each may qualify for a green card through a single company.  However, the individual investment of each person must still be for the minimum qualifying amount, and each investor must be separately responsible for the creation of ten new jobs.  For example, if five individuals each invest $1 million in a new business that will employ at least 50 American workers, all five investors qualify for green cards

    Although it is expected that the investment will be well underway when the green card application is made, the law does require the investment to be in a completely new commercial enterprise.  There is an exception to this rule. The investor can purchase an existing business if he or she increases either its net worth or a number of employees by at least 40%.  The rules requiring $1 million investment and ten employees still apply, however.  Therefore, the existing business must be large enough so that 40% increase will amount to the fixed required dollar and employment minimums in the category.

    If the existing business purchased is in financial trouble, an investment designed to save that business will qualify the investor for a green card in this category.  Purchasing a troubled business releases the investor from having to increase the net worth of the number of employees.  It does not, however, excuse the $1 million minimum investment requirement.  To qualify as a troubled business, the company must have been in operation for at least 2 years, and have had an annual loss during those two years equal to at least 20% of the companyâ?Ts net worth.  An investor buying a troubled business is prohibited from laying off any employees.

    A green card for an investor is first issued only con***ionally. The con***ional green card is granted for 2 years.  When the 2 years are over, the investor will have to file a request with the INS to remove the con***ion

    In deciding if the con***ion should be removed, the INS will investigate whether or not the proposed investment has actually been made, if 10 full-time American workers have been hired, whether or not the business is still operating and if the business is still owned by the investor who got the green card.  When any of the required factors cannot be established to the satisfaction of the INS or the petition for removal of the con***ion is not filed within the final 90 days of the 2 year con***ional period, the investor will lose his or her green card and be subject to removal from the US (deportation).  If, on the other hand, the INS is satisfied that the investment still meets all requirements, the con***ion will be removed and a permanent greed card issued.
