    Business Visas and Green Cards
    I refer to your queries in which you wish to obtain information in relation to the subject matter and would like to advise hereunder.
    A. Business Visas
    I am aware that a non-immigrant alien may apply to obtain the following types of non-immigrants visa in order to admit to, and legally work in, the US:
    (i) B1 visa - Temporary Business Visitor;
    (ii) Visa Waiver Program;
    (iii) E visa - Treaty Trader and Investor;
    (iv) H1B visa - Temporary Worker in A Specialty Occupation;
    (v) H-3 visa - Trainee;
    (vi) L1 visa - Intracompany Transferee; and
    (vii) O visa (Person of Extraordinary Ability).
    This is not to mention that a person may also obtain F1 practical training visa or J1 practical training visa in order to reside and work in the US legitimately. Please let me know should you wish me to explain any of the above-mentioned visas in detail.
    I would like to draw your attention to the most recent legal instrument which shall highly affect the application for such visas. Following the requirements set out in Section 303 of the Enhanced Border Security and Visa Entry Reform Act, the Department of State issued a notice on 24 June 2004 to discontinue the re-validation of working visa categories C, E, H, I, L, O, and P in the United States after 16 July 2004. This means that your wish of residing for a long period of time in the US based on a non-immigrant visa may be highly affected.
    You also query the chance for you to obtain a permanent immigrant visa. When I return I shall provide all categories under which a person may apply for a Green Card. Depending on this information, and your personal factual situations, you shall be able to decide which way shall be the best for you to obtain a Green Card.
    You may need to engage an immigration lawyer in the US to assist you with this.

    Thank you so much, analysist. My work contract is valid from Aug 2004 on. Of course, i can delay but it''s better if i have enough time getting started with the work and research group there. Do you think i should ask the professor to do something for my visa application?

    There is no need to ask your professor in the US school to interfere the visa process since the length of such process fall under the jurisdiction of the visa section of the Embassy or General Consulate.
    Please telephone the Embassy, or the Consulate, where you are residing in Germany and ask them approximately how long the process may take. I think if you have all required documentation, and apply now, you are more likely to obtain a visa at the end of August to commence the fall semester.

    There is no need to ask your professor in the US school to interfere the visa process since the length of such process fall under the jurisdiction of the visa section of the Embassy or General Consulate.
    Please telephone the Embassy, or the Consulate, where you are residing in Germany and ask them approximately how long the process may take. I think if you have all required documentation, and apply now, you are more likely to obtain a visa at the end of August to commence the fall semester.

    Would you please explain further about the E visa? How long does it take for this type of visa to expire? Since they would not allow the re-validation of those mentioned types of visa, it means that ones who hold such visas have to reapply for those every time of expiration?
    And I would also want to know about the waiver program. May visa holders of other types apply for the waiver program after a certain period of time or after the first expiration of their visas?
