    Mùa hè là thời điểm mà đa số mọi người lập kế hoạch để đi du lịch. Du lịch vòng vòng trong nước thì ko sao , nhưng khi đi du lịch ra khỏi U.S thì ko tránh khỏi những thắc mắc,dù lớn dù nhỏ, nhất là đối với những người non-citizens. Sẵn dịp mình có đọc được một vài thông tin khá hữu ích nên post lên đây mong là giúp được chút xíu để các bạn yên tâm mà có những chuyến du lịch quốc tế vui vẻ.
    Bài post là những câu trả lời dựa trên những thắc mắc thưòng có khi các bạn đi du lịch.

    1) What if i have lawful permanent residence (green card)?


    If you have a green card, you normally need to present your valid green card and a valid passport for re-entry. However, permanent residents must maintain their status as residents and may lose that status if they leave the U.S for extended periods.
    It is important to talk with an attorney if you intend to remain outside of the U.S for six-months or more. In ad***ion, a separate "re-entry permit" is needed to preserve legal residence if the trip is greater than one year but less than two years in duration.
    Moreover, significant absences from the U.S may break the continuous and or physical presence requirements for purposes of Naturalization.
    Even after obtaining a green card , a former refugee or asylee should consult with an immigration attorney before traveling to the country of persecution or before traveling on the passport of that country.

    2)My application for a green card is pending. May i travel before a decision?
    Generally, you may travel if you have advance parole document and the travel is for a bona fide business or personal reason. Refugees or asylees do not need advance parole to travel while their adjustment of status application is pending, but they do stiil need an unexpired refugee travel document. You should consult with an attorney before you travel if you have been unlawfully in the U.S or if you have a prior criminal history.

    What if i am an asylee or refugee?
    Individuals who have been granted asylum or refugee status may travel abroad with prior approval, called a "refugee travel document." A refugee travel document is valid for one year and is issued to an asylee to allow his or her return to the U.S after temporary travel abroad. The refugee travel document can, and should, be used instead of the passport from the country of persecution. The refugee travel application should be filed prior to departurefrom the U.S.
    It is important to note that a refugee travel document does not guarantee re-admission into the U.S. Asylees and refugees will still be inspected by an immigration inspector before being allowed to re-enter. In ad***ion, asylees and refugees may be at risk of losing their status if they travel to the country from which they fled. Even travel with that country''s passport can pose a risk to status.

    If an asylum applicant must travel internationally he or she must receive "advance parole" before leaving the U.S. Otherwise they will be presumed to have abandoned their asylum application. Advance parole allows certain aliens to return to the U.S without a visa after traveling abroad.
    Although an applicant may receive advance parole permitting them to travel, if they return to the country from which they fled their application will generally be denied.
    In ad***ion, advance parole does not serve in place of a passport and does not guarantee that the applicant wiil be allowed to reenter the U.S., because they must still go through immigration inspection. Asylum applicants should always axercise extreme caution when considering any international travel.

    Any non-citizen who departs the U.S. runs the risk of not being allowed to re-enter the country. It is especially important to discuss your situation with an attorney if you have been unlawfully present in the U.S at any time. Depending on the amount of time you have been unlawfully present in the U.S., once you leave, you may not be allowed to re-enter for 3 or even 10 years.
