USCIS ANNOUNCES NEW H-1B PROCEDURES õ?" REACHES CAPWashington, D.C.õ?" U.S. Citizenship and Immigration Services (USCIS) announced today that it has received enough H-1B petitions to meet the congressionally-mandated cap for fiscal year 2005. Congress has set an annual H-1B cap of 65,000 of which 6,800 are set aside for the H-1B1 program under terms of the U.S.-Chile and U.S.-Singapore Free Trade Agreements. The total H-1B cap number available for FY 2005 is therefore 58,200. USCIS has factored into its count of petitions subject to the FY05 cap the number of Chile/Singapore set-asides that were unused in FY2004 and any other cases that can be counted against the previous fiscal yearõ?Ts H-1B cap rather than the FY 2005 cap. USCIS has received enough petitions to reach the limit for FY 2005.
After today, USCIS will not accept any new H-1B petitions that are subject to the FY 2005 annual cap.
For the remainder of FY 2005, USCIS will follow the procedures set forth in the notice published on February 25, 2004 in the Federal Register at 69 FR 8675 to address the cap reached during FY 2004. Those procedures include:
õ? USCIS will process all petitions filed for first-time employment received by the end of business today.
õ? USCIS will return all petitions for first-time employment subject to the annual cap received after the end of business today.
õ? Returned petitions will be accompanied by the filing fee.
õ? Petitioners may re-submit their petitions when H-1B visas become available for FY 2006.
õ? The earliest date a petitioner may file a petition requesting FY 2006 H-1B employment with an employment start date of October 1, 2005, would be April 1, 2005.
USCIS plans to provide further details on these procedures in a new notice that will be published in the Federal Register shortly.
Petitions for current H-1B workers do not count towards the congressionally mandated H-1B cap. Accordingly, USCIS will continue to process petitions filed to:
õ? Extend the amount of time a current H-1B worker may remain in the United States
õ? Change the terms of employment for current H-1B workers
õ? Allow current H-1B workers to change employers
õ? Allow current H-1B workers to work concurrently in a second H-1B position
USCIS also notes that petitions for new H-1B employment are not subject to the annual cap if the alien will be employed at an institution of higher education or a related or affiliated nonprofit entity, or at a nonprofit research organization or a governmental research organization

Khiếp, đọc cả bài của bác gì làm em tưởng em sẽ bi delay, may quá có cái đoạn cuối này.
Employer của em bào khoảng giữa tháng 12 sẽ có thông tin về các giấy tờ cần thiết để gửi cho em xin H1B. Hiện em đang kẹt quả hộ chiếu còn ngắn hạn quá, mà lại ko xin đổi được hộ chiếu mới ở đây, chắc em phải về VN lấy họ chiếu rồi sang xin VISA vây.
Không có gì trục trặc thì đầu tháng 3 em làm người nhà của box các bác.
Họ bảo em chọn J1 hay H1 em chon H1 để nếu có permanent position thì họ file greencard cho em luôn.

Bạn hoàn toàn có thể đổi, gia hạn hộ chiếu ở Mỹ, gửi hộ chiếu đến ĐSQ Việt nam ở DC hoặc không ra mấy trung tâm dịch vụ tổng hợp, người ta làm dịch vụ cho bạn, rất dễ dàng.

Thanks Netwalker (you walk so fast), hiện mình đang ở Hàn Quốc mới chít chứ, hôm qua nằm cả ngày trên ĐSQ mà các bác ý không chịu renew hộ chiếu cho mình, cái chính là mình hơi dại hồi đầu lên đăng ký học tập mình bị lòi cái đuôi là cán bộ đi học (do bộ NN cử đi - tuy nhiên thực tế thì ko phải là học bổng của nước nào cả - dự án của GS hướng dẫn trả tiền cho mình toàn bộ) thế nên các bác ý đòi quyết định của Bộ NN thì mới chịu renew.
Mình cũng thừa hiểu là các bác ý làm khó dễ cho mình chứ hộ chiếu phổ thông thì không cần cái đó (quyết định của bộ NN), điều các bác ý nói chỉ có thể đúng nếu bác ý cấp hộ chiếu công vụ cho mình. Noí chung là bất lực, chắc phen này về phải làm cái đơn xin thôi việc hoặc là phải dấu tiệt cái chuyện cán bộ cán beo đi và coi như là anh học sinh tự do thôi. Khổ thế đấy, tưởng là người nhà nước thì được ưu tiên hoá ra chỉ bị hành thêm.

Cả nhà mình cho tớ hỏi với, có bác nào có kinh nghiệm phỏng vấn VISA đi làm (H1B) ở ĐSQ Mỹ tại Hà nội (hơặc thành phố HCM) chưa? và phỏng vấn loại VISA này có khó khăn hơn các trường hợp khác không?
Hiện mình có 2 options là có thể xin ở ĐSQ Mỹ tại Seoul hoặc ĐSQ Mỹ ở Hà nội, vậy nên apply ở đâu thì tốt hơn (Ở ĐSQ Mỹ ở Seoul thì phải hẹn interview mất 11 ngày, sau đó mất bao lâu để issue VISA thì còn chưa biết).

This is part of the $388 billion Omnibus Appropriations Bill that was passed by Congress late on Saturday night. It is expected to be signed into law by President George W. Bush in the next few days.
The ad***ional 20,000 visas will be reserved for International Students in American universities with master''s or doctorate degrees.
The ad***ional H1B visas for up to 20,000 eligible foreign students will be treated as an ''exemption'' from the current cap of 65,000. This measure, preceded by months of hectic lobbying by US industry, will benefit thousands of International students who are either waiting in American campuses or back at home.
Many of them had earlier lost out because the competition was so intense that the current annual quota of 65,000 H1B visas was snapped up on day one of the new fiscal year, which started October 1, 2004.
