Em đang làm cho 1 công ty rồi,công ty ấy xin H1B cho em.Nếu có cách gì không gián đoạn công việc trong thời gian lag đấy thì may quá.Việc em có được H1B hay không thì mong Chúa Trời thương em chứ em chưa biết anh ạ.

nếu K không lầm thì kết quả KSK của bạn hiện đang nằm trong tay USCIS rồi. Thông thường thì kết quả KSK được niêm phong trong 1 phong bì, và khi bạn làm thủ tục tại cửa khẩu Mỹ thì HQ cửa khẩu sẽ giữ hồ sơ đó và chuyển về USCIS luôn.
Lâu quá rồi nên không nhớ được là I-485 (adjustment of status) có đòi giấy chích ngừa (immunization record) không nữa, nếu có thì bạn phải tìm kĩ lại thôi. HQ cửa khẩu KHÔNG có thu immunization record của bạn.

Em nghe nói chính phủ Mỹ mới ra luật mới là visa F1 có quyền extend thêm thời gian OPT thêm 17 tháng cho một số ngành có đúng không ạ? Luật này đã được thực thi chưa hả anh? Và nó được áp dụng trong trường hợp nào (ai có quyền xin extend) hay là cứ bị quá thời gian 12 tháng OPT mà chưa kịp apply for H1B thì có quyền xin? Có phải được extend thêm 17 tháng tức là sẽ có 12+17=29 tháng cho OPT không anh hay là chỉ được thêm 5 tháng? (12+5=17)
Chẳng hạn F1 đang trong thời gian OPT (thời gian thừa còn nhiều) thì spouse có khả năng xin được F2 không anh?

Effective today, April 08, 2008, USCIS regulations pertaining to Optional Practical Training (OPT) allow greater flexibility and extended duration of employment authorization for eligible students currently on OPT or planning to apply for OPT in the future.
For full details regarding new benefits, new reporting requirements, and new restrictions, please see below:
NEW BENEFITS
1. OPT Extensions (up to 17 ad***ional months) for graduates of certain programs
a. Recipients of bachelorõ?Ts, masterõ?Ts, and doctoral degrees in certain STEM (science, technology, engineering, mathematics) fields are eligible for a one-time 17-month extension of post-completion OPT (for a total eligibility of up to 29 months).
b. To be eligible for the extension, the studentõ?Ts employer must be registered in E-Verify (see www.uscis.gov for ad***ional info), and agree to report to CIS when the student is terminated or leaves employment. The student must also agree to comply with ad***ional reporting requirements that are described in the section of this email called, õ?oNew Reporting Requirementsõ?
c. Applications for the 17-month STEM extension must be filed before the current Employment Authorization Document (OPT card) expires.
2. Duration of employment authorization
a. Employment authorization will begin on the date requested or the date the employment authorization is adjudicated, whichever is later.
b. Exception: The employment authorization period for the 17-month OPT extension begins on the day after the expiration of the initial post-completion OPT employment authorization, and ends 17 months later, regardless of the date the actual extension is approved.
3. OPT filing deadlines
a. The new rule allows students to file for OPT up to 90 days before the I-20õ?Ts program end-date and up to 60 days after the I-20õ?Ts program end-date, provided that it is filed within 30 days of the date CIS enters the OPT recommendation into SEVIS.
4. H-1B cap-gap extension until October 1.
a. Duration of status and work authorization will be automatically extended for a student on OPT, who is the beneficiary of a timely-filed H-1B petition requesting change of status and an employment start date of October 1 of the following fiscal year.
b. This would apply to all qualified students on OPT, not just STEM students. The extension of duration of status and work authorization would automatically terminate upon the rejection, denial, or revocation of the H-1B petition filed on the student''s behalf.
NEW REPORTING REQUIREMENTS
All students on OPT are required to report to CIS:
any change of name or address, or
any interruption of employment (i.e., any period of unemployment)
ã Students receiving a 17 month extension of their OPT must agree to notify CIS within 10 days of any change of:
1. legal name
2. residential or mailing address
3. employer name
4. employer address, and/or
5. loss of employment.
6. If there is no change to the information above, then the student must report that there has been no change every six months starting from the date the extension begins and ending when the studentõ?Ts F-1 status ends.
ã Ad***ional requirements for the 17-month extension include:
Student must be currently participating in a 12-month period of OPT, working for a U.S. employer in a job directly related to the studentõ?Ts major area of study.
Student must have successfully completed a bachelor''s, master''s, or doctoral degree in a field on the DHS STEM Designated Degree Program List, from a SEVIS-certified college or university.
Student must have a job offer from an employer registered with the e-verify employment verification system.
The student has not previously received a 17-month OPT extension after earning a STEM degree.
CIS must recommend the 17-month OPT extension in SEVIS, after verifying the student''s eligibility, certifying that the student''s degree is on the STEM Designated Degree Program List, and ensuring that the student is aware of his or her responsibilities for maintaining status while on OPT.
Student will have to apply for the 17-month extension on Form I-765 with fee.
Students who timely file an application for the 17-month OPT extension will be able to continue employment while the extension application is pending, until a final decision on the I-765 or for 180 days, whichever comes first.
The employer must agree to report the termination or departure of the student to CIS or through "any other means or process identified by DHS." An employer must consider a worker to have departed when the employer knows the student has left employment, or if the student has not reported for work for a period of five consecutive business days without the employer''s consent.
NEW RESTRICTIONS
ã Effect of periods of unemployment while on OPT
1. The new rule states that during OPT, F-1 status is dependent upon employment. This means that during regular OPT, no student (including STEM students) may be unemployed for a total of more than 90 days during the 12 month period.
2. If a STEM student receives a 17-month extension, the limit on unemployment is raised to a total of no more than 120 days, applied to the entire 29-month period on which the student is on OPT
OTHER NEWS: H-1B Cap Reached for 2009
As of April 7, 2008, the USCIS H-1B cap of 58,200 and the ad***ional cap of 20,000 for employees with a Masterõ?Ts or higher degree from a U.S. college or university have both been reached.
USCIS will now log in all received H-1B petitions and conduct a random selection process for H-1Bs to be considered for processing toward this yearõ?Ts caps. This is similar to the computer lottery that took place last year. USCIS does not know when this data entry will be complete, but you can check www.uscis.gov for updates.
Nonetheless, cap exempt employers (e.g., many colleges and universities) remain unaffected.

Về việc của em, giả sử rằng đúng em sẽ nhận được approval của H-1B vào tháng 6 và em phải ra khỏi Mỹ để đóng visa thì em nên làm passport trước đó và sau đó thì tùy em quyết định sẽ về Việt Nam hay ra nước lân cận để lấy . Anh nghĩ nếu chưa về thì cũng nên về Việt Nam một chuyến rồi làm passport từ Việt Nam luôn cho rẻ .
