    (1) I am aware that you must be a US citizen (inter alia or amongst other things) before you shall be eligible to sponsor your family under family migration scheme.
    (2) Assuming you could sponsor your Dad, you must apply in the US first to obtain approval before your Dad shall be called to be interviewed or the like at the Embassy in Vietnam. Whether you could obtain a tourist visa for him is a different story. With that visa he is permitted to stay in the US under a limited period of time and must return to his home country. Your petition for sponsoring him will normally take longer than the period he is permitted to reside in the US temporarily.
    (3) I am not very sure that you would be able to easily obtain a tourist visa for him given that the US is aware or have evidence that you are applying to sponsor him to reside permanently in the US.
    (4) Please go to the US State Department website to read the requirements for a US citizen to sponsor alien.
    (5) I am not aware of any Vietnamese local law firm which is capable of handling the case for you. You could, however, engage a US law firm in Vietnam but I know that they normally charge you 300 USD at least per hour. Fred Burke in Baker & McKenzie is charging almost 500 USD per hour.

    The procedures for amending a name is a piece of cake in a common law country as the US.

    (1) I am not sure what you mean by green card. You mean it shall be a permanent resident or a H1B visa which shall permit you to work in the US. If you just finished school and wish to obtain a permanent residence I am not aware that a US company shall be able to do this for you. There are four categories under which a person shall be able to apply for permanent residence and the requirement in your case (graduate) is harsh. Amongst those requirements you must have many years of working experience not that you just finished university and can have a US company to sponsor you to obtain a green card.
    (2) If you wish to know the requirements in detail. Please go to USCIS website and read them.
    (3) I am not aware that any lawyer in the US shall offer to find a sponsoring employer for you. You find employer and provide documentation for a lawyer to assist you with application for a H1B visa.
    (4) Please note that H1B visa which is very common for an alien in the US to work legally after graduation, is capped. This year the cap has been reached and a person, though being eligile, must wait until the next "quota" which I assume will occur in October 2004.
    (5) You must be very quick to apply for H1B.

    Hi Analyst & Netwalker,
    I have recently sent the packet 3 to the US Embassy in HoChiMinh city for a fiance visa. I heard that it is going to take 3 months for them to have a date for my interview, and it would take another month for it to really be taken place. Is that true? My fiance is here with me waiting to go with me to the interview, and his visa is going to expire in another 3 months. Please let me know if they are going to take that long for me to have my interview taken place? And my approval will expire on the 15th of August, does that mean that I can have my interview before then? And if it is really going to take that long then do you think I can have a company or a lawyer to rush them off?
    By the way, can my fiance fill the packet 3 out for me when he submitted the papers to the immigration people?

    Can you please let me know if you are, or will be, married inside or outside the United States. I understand that the process for a petition to obtain a permanent resident visa for you, submitted by the US citizen, shall take about six months to finish. There is no lawyer who can push the assessment process. He or she however can write to the USCIS or the Embassy asking the status of your case. However, I am aware that under three months are acceptable.
    I am also aware that the Embassy is less likely to ask both of your to attend an interview together. They may ask two of you to be interviewed separately and an interview to the US citizen may be carried out in the US.
    Please answer my question and tomorrow when I go to my office I will re-read the legal requirements for this case. I am not having any sources at home. I forget the requirements where a marriage takes place outside the US which appears to be your case.
    Your fiance can complete the form(s) for you but you must sign them where required.
    If there is an anxiety on this case the more anxious you are the more likely you will fail the visa. If your marriage is truthful you will have a con***ional visa for two years pending the con***ion to be petitioned to be removed in the US by your husband. Trust me.
