    Vấn đề này cháu cũng mới nghĩ tới khi chau'' sang học o đây thôi ...đó là sự chênh lệch quá lớn giữa học phí va quyền lợi khi cháu du học o Canada. Bạn bè cháu cũng có đứa làm kết hôn giả nhưng cháu đang phân vân vi` không biết khi bảo lãnh thi` những thủ tục cần co'' la` gi` va` khi trong thời gian chờ thi` có phải trở về Viet nam không ? Vì hiện tại chau'' đang o Ca rồi , nếu phai về chỉ để chờ thi tôn'' thời gian va gián đoan chuyên học.Và trong những chuyện như vây thì nhất thiết cháu có cần luật sư không ah?Va` cháu dược biết nếu ******** nguyen thì trường đai học sẽ cấp work permit cho international student....Vậy cháu có thể dùng giấy đó để đi làm thêm o ngoái và ******** nguyện khi rãnh được không?

    I can immediately answer a question the answer of which is in my mind. Otherwise it often takes time for me to reply since I will need to re-read the laws, and regulations, to make sure they have not been changed.
    (1) I will let you know later what documentation is required to apply for migration on the ground of marriage. I will need to read laws. From the top of my head, your spouse who is a US citizen shall need to petition form I-129 (or I-130). This will be confirmed.
    (2) Whilst awaiting the approval whether or not you must go home depending on your legal status. If your visa is expired you must depart the US. Otherwise you will have huge trouble at the interview.
    (3) You will need to engage an immigration lawyer unless or until you are thorough with, or master, legal requirements (as am I or better) for your case. I am aware most of the applicants engage a lawyer.
    (4) You must abide by the requirements set out in the work permit and I understand you shall not be permitted to work outside the "jurisdiction" set out in the work permit. I think the term "work permit" is wrongly used herein. Work permit is only issued following an application for working off-campus is lodged where a student encounters hardship. What you mentioned in your message appears to be a H1B visa (which is exclusive of the cap). I have not re-read the law but, from the top of my mind, where you change an employer, you must re-submit to change your H1B visa. It is not easy to obtain a work permit from the USCIS as a student whilst you are holding a F1 visa (as a non-immigrant alien since F1 is also an immigrant visa category).

I shall return and provide you with documentation required to petition a temporary green card (or con***ional green card of two years) for you. If you wish please visit the USCIS website for a list of documentation whilst awaiting my answer. If you will please let me know so that I will say something else on top.
    Now I come back to the question what to do where such person lost his or her green card.
    (1) As said by Net, you shall need to petition form I-90. There are two ways that you can petition this (a) off-line or (b) online. The documentation required to be attached to the petition shall be slightly different in each case.
    (2) If you choose *****bmit off-line, you should lodge the form (plus supporting documents and photos) in person to the regional office of the USCIS which covers your area. Please telephone 1 800 870 3676 for the location of such office. This is a free number in the US.
    (3) I would like to draw your attention to section 264 of the Immigration and Naturality Act (1951) which provides that, should you do not have your green card with you at the time when you are asked you shall commit a misdemeanor and may be monetarily penalized or jailed. Let me know if you wish me to quote the law and explain in plain English for you.
    (4) Where you are applying for a lost green card and wish to travel, you may apply for a temporary document which shall allow you to travel out of, and to re-admit to, the US. USCIS regional office shall be able to assist you with this.
