Chào bạn, mình có vấn đề này cần advice của bạn.
Năm rồi mình và mom được bảo lãnh wa Mỹ do step father của mình. Mình wa tháng 11/02 còn mẹ của mình wa tháng 3/03. Tới tháng 11/04 này thi greencard của mình hết hạn. Theo mình được biết thì mẹ mình có thể apply cho thẻ xanh chính thức trong vòng 3 tháng trước khi hết hạn với lý do vợ chồng. Nhưng mà thẻ xanh của mình hết hạn trước so với thẻ xanh của mẹ mình. Vậy khi mình apply cho thẻ xanh mới, mình lấy lý do như thế nào? Mình tiếp tục apply cho thẻ xanh tạm or thẻ xanh chính thức. Vì người bảo lãnh chỉ là step father cho nên mình ko có dính dáng gi nhiều với người ấy cả.

Can you please let me know on what category that you could obtain your green card in the US. To avoid confusion, you had such as a result of being a dependant to your Mom or on what basis?
What category your step-father sponsored you to the US though?

Ok, let me briefly tell u the situation.
My step father married my mom when i was still under 18, and he sponsored me and my mom to the US, and I think I obtained a green card in that case. However, I almost have no relationship with him, and since i came here, I did not live with him but I havent changed my address with the INS yet. I mean the address on my driver license and social security card is his address. However, I use my address for the bank, school, jobs, etc.... He claimed me on his tax file when i was under 18, but he did not do it anymore since i turned 18.
My greencard expired and the end of this year. I dont know wat I should do. In this case, the one who i have relationship with is my mom. So do I have to wait till she get her permanent greencard which valid in 10 years and then she can sponsor me. My greencard expired before hers 4 months.
Please give me some advices. Thank you.

Thanks for telling me the story. However, that is not what I need. I will need to know exactly what category your step father sponsored your Mom and you to the US.
I can presume based on your provided information that you obtained your green card as a dependant to your Mom (under marriage category). You Mom had green card under the category of being marriage to a US citizen.
If this is the case, you Mom is possessing a con***ional permanent visa. The con***ion will last for two years and your father is the only person who can petition the US Citizenship and Naturality Service ("USCIS") to remove the con***ion. Once the removal takes place both will become permanent residents with its true meaning.
You are as a dependant to your Mom. Therefore, your visa is con***ional as well and can only be removed by the petition of your step father.
Regardless of the above, since I do not know the category under which you fall under, I cannot advise you. Please go to the USBCIS website, obtain its toll free number and call and ask them. They will check your category on their computer system and will advise you accordingly.
