Em hỏi về giám hộ
1 . Theo như bộ luật dân sự 2005, tại điều 62 nói về người giám hộ đương nhiên của người mất năng lực hành vi dân sự

em thấy người ta không nhắc đến người thân thích như cô dì chú bác như điều 61(người giám hộ đương nhiên của người chưa thành niên). Tại sao vậy ?( cả 1995 và 2005 đều nói thế )
2. Có ý kiến đề nghị bỏ quy định: ?oTrong trường hợp người chưa thành niên, người bị mất năng lực hành vi dân sự không có người giám hộ đương nhiên theo quy định tại Điều 61 và Điều 62 của Bộ luật này, thì những người thân thích của người đó cử một người trong số họ làm người giám hộ? vì cho rằng, nếu người chưa thành niên, người mất năng lực hành vi dân sự mà không có người giám hộ đương nhiên theo quy định tại Điều 60 và Điều 61 dự thảo Bộ luật thì lúc này bản thân họ không còn ai trong số những người thân thích để cử làm người giám hộ.
Tiếp thu ý kiến trên đây, Uỷ ban thường vụ Quốc hội đã cho bỏ nội dung trên và chỉnh lý Điều 63 như trong dự thảo. (trích báo cáo, giải trình tiếp thu chỉnh lý dự thảo bộ luật dân sự ngày 27/4/05)
Theo như thế này thì em thấy ko đúng lắm vì ở điều 62 cũng ko nói là có người thân, nên theo em cũng ko cần sửa, điều 63 ở đây nói vậy theo em là đúng. Vậy thì sửa đổi có đúng ko và nó hợp lí hơn ở chỗ nào ? xin các bác câu trả lời, em ko hiểu
3. Còn câu cuối nữa, theo điều 59 BLDS 2005 về giám sát việc giám hộ có đề cập thêm về việc người thân thích, còn điều 68 BLDS 1995 cũng với tiêu đề như vậy nhưng ko có người thân thích, việc sửa đổi như vậy có gì tốt hơn ? xin các bác nói rõ ra hộ em, em hiểu sơ sơ thôi
